Chapter 702 R Ordinance

IV.  TITLE VII, CHAPTER 702 ST. LOUIS COUNTY REVISED ORDINANCE 1974 AS AMENDED

 

SECTION 1.  Title VII, Chapter 702 SLCRO 1974 as amended, "Division of Fire and Accident Prevention" is amended by repealing therefrom Sections 702.100, 702.110, 702.120 and 702.130 and by enacting and adding in lieu thereof five new sections as follows:

 

702.100  Training & Educational Standards Established.  By the authority vested in it by the St. Louis County Charter, the Fire Standards Commission of St. Louis County, Missouri, has adopted minimum training and educational standards as well as rules and regulations relating to firefighter training which must be met by firefighters employed by any municipal fire department, fire protection district or other public agency within six (6) months after their appointment as firefighters.  A copy of said standards and regulations shall be filed with the Administrative Director of the St. Louis County Council and shall be updated whenever said standards or regulations are changed pursuant to said Commission's procedures.

 

702.105  Provision of Training.  The St. Louis County Fire Standards Commission is hereby authorized to provide minimum training and education independently or by way of a contract with the Greater St. Louis County Fire Academy or such other or successor organization(s) as they deem appropriate to perform basic training and education of firefighters in compliance with the Commission's standards as established, changed and updated from time to time as the Commission sees fit.

 

702.110  Period for Meeting Standards Established.  1.  No person may be employed to perform the duties of a firefighter for any municipality, fire protection district, or other public agency after January 1, 1985, unless such person meets such standards within six (6) months of the beginning of such service.  Thereafter, such person shall not be eligible for employment or appointment as a firefighter by any municipality, fire protection district, or public agency for a period of one year from the expiration of the six month period for training unless such person successfully meets the standards established by the Fire Standards Commission.

 

2.  The foregoing provisions shall not apply to:

 

       a.  Volunteer Firefighters;

       b.  Persons who served as fire-fighters in St. Louis County, Missouri, for twelve 
            (12) consecutive months prior to January 1, 1985; or

       c.  Persons appointed to the position of fire-fighter during a state of emergency
            declared by the County Executive.

 

702.120  Employment of Persons not Meeting Standards.  1.  The executive officer(s), regardless of title, rank or assignment, authorized to hire and fire fire-fighters for any fire department of any municipality, fire protection district, or other public agency shall terminate any person employed to perform the duties of a fire-fighter if such person fails to meet the standards referred to in Section 702.100 hereof within six (6) months of the date such person was employed or appointed; provided, however, that the foregoing provisions shall not apply to (a) volunteer fire-fighters; (b) persons who served as fire-fighters in St. Louis County, Missouri, for twelve (12) consecutive months prior to January 1, 1979; or (c) persons appointed to the position of fire-fighter during a state of emergency declared by the County Executive.

  

2.  The executive officer(s), regardless of title, rank or assignment, authorized to hire and fire firefighters for any fire department of any municipality, fire protection district, or other public agency shall not employ or appoint any person who, while previously employed by or appointed to a position as a fire-fighter for any municipal fire department, fire protection district or other public agency failed to meet the standards referred to in Section 702.100 hereof within six (6) months of such original appointment, until such person shall meet those standards or until one year has elapsed from the expiration of the six month period for training, resignation or termination required by Section 6.040, Paragraph 2 of the St. Louis County Charter.

 

3.  The executive officer(s), regardless of title, rank or assignment, authorized to hire and fire firefighters for any fire department of any municipality, fire protection district, or other public agency shall prepare and forward to the Fire Standards Commission an annual roster of all persons employed by said department, district or agency particularly those performing the duties of firefighter as defined in the rules and regulations of the St. Louis County Fire Standards Commission.  Such roster shall contain the names, job titles, descriptions of duties, salary, social security numbers, dates of birth, dates of hire, dates of training, dates of certifications and any other pertinent information requested by the Commission on the forms provided by the Commission.  Such information shall be submitted no later than March 1st of each calendar year; shall include all employees and shall contain information accurate through January 1st of that calendar year.

 

702.130  Penalties.  1.  Every person who is convicted of a violation of this chapter or of the rules and regulations promulgated by the St. Louis County Fire Standards Commission shall be punished by imprisonment in the County Jail for a period of time not exceeding one year, by a fine of not less than $50.00 nor more than five hundred dollars ($500.00), or by both such fine and imprisonment.  Each day a violation continues shall be considered a separate violation.

 

2.  In addition to the penalties hereinabove authorized and established, the County Counselor shall take such other actions at law or equity as may be required to halt, terminate, remove, or otherwise eliminate any violations of this chapter or the rules and regulations of the St. Louis County Fire Standards Commission.
