CIVIL JURY AND EQUITY CASES FOR DIVISION 42


MOTIONS:

  • Motions are set by contacting the Division 42 clerk at (314) 615-1542.

  • Your motion date is not scheduled until the court receives your Notice of Hearing.

  • All Notices of Hearing should be sent directly to the attention of the Division 42 clerk to     ensure proper scheduling.

    PRETRIAL CONFERENCES:

  • All parties will be notified of the pretrial conference date by the Division 42 clerk.

  • All attorneys of record and Pro Se litigants must be present for the pretrial conference.

  • Failure to appear at a pretrial conference, without good cause, may result in dismissal of     the party's claims.

  • A pretrial order will be entered setting the discovery schedule and the trial date.

  • Failure to comply with the pretrial scheduling order may result in dismissal of a claim or     the imposition of other sanctions.

  • Attorneys and Pro Se litigants are expected to bring their calendars to the pretrial     conference.

  • Parties who are represented by counsel may be present in person or available by     telephone.

  • A request for a continuance of a pretrial conference should be made to the Division 42     clerk at (314) 615-1542 as early as possible after receipt of the notice.

  • Consult with opposing counsel prior to requesting a continuance of a pretrial conference.

  • The party requesting a continuance must file the continuance memo with the court and     provide notice to other parties of the new pretrial conference date.

  • Parties are encouraged to discuss with their clients the possibility of mediation prior to     the pretrial conference.

    TRIALS:

  • Trial settings are set by the judge at the pretrial conference.

  • Requests for continuance of a trial setting should be made in writing and should be     made as early as possible.

  • Once the case is set for trial, the court will not allow an attorney to withdraw without     good cause.
