Family and Medical Leave Act (FMLA) Definitions Employee - Includes all individuals employed by St. Louis County Government without reference to the number of hours worked. Employer - St. Louis County Government FLSA - Fair Labor Standards Act Health Care Provider - A licensed doctor of medicine or osteopathy, or any other person determined by the Secretary of Labor to be capable of providing health care services. "Any other Person" could include those who provide spiritual treatment through prayer alone, such as Christian Science practitioners. Hours of Service Requirement - The minimum hours of service requirement should be construed broadly, with the determining factor being the numbers of hours an employee has worked for St. Louis County Government within the meaning of the Fair Labor Standards Act (FLSA). Methods of recordkeeping or compensation agreements that do not reflect all the hours an employee has worked may not be used as a limiting factor. Intermittent Leave - Leave taken in separate periods of time due to a single illness or injury, rather than for one continuous period. Pay Status - The time for which an employee is entitled to compensation under the Fair Labor Standards Act. Generally, that is the time an employee is required to be on duty and the time that the employee is "suffered or permitted " to work, whether or not the employee is requested to do so. Parent - A biological parent of an employee or an individual who stood in the place of a parent to an employee when the employee was a son or daughter. Reduced Schedule Leave - A leave that reduces an employee's usual number of hours per work day or hours per work week. Serious Health Condition - An illness, injury, impairment, or physical or mental condition that involves either:
Spouse - A husband or wife. This includes an unmarried domestic partner. Son or daughter - Any person who is under 18 years old or any person 18 years old or older who is incapable of self-care because of a mental or physical disability whose relationship to the employee is that of:
