PROBATE COURT - ADMINISTRATIVE ORDER

This order has been posted again for informational purposes in regard to the Procedural Changes Notice dated September 11, 2009.
Administrative Order to Mandate the Requirement of Social Security Numbers and Birth Dates of Parties to New Probate Cases in Compliance with Supreme Court Operating Rule 21.06 and the National Instant Criminal Background Check System (NICS)
On April 3, 2006, Probate Court Judge B.C. Drumm, Jr. issued the following administrative order.
WHEREAS, Supreme Court Rule 21.06 effective July 1, 2006, requires that all courts utilizing the Justice Information System (JIS) must participate in the Missouri Court Tax Offset program; and
WHEREAS, it is the purpose of the National Instant Criminal Background Check System (NICS) to report persons who should not be allowed to purchase handguns to the Missouri Criminal History repository which is handled by the Missouri State Highway Patrol. The persons who will be reported are those who have been found mentally incompetent in criminal cases or have been adjudicated as incapacitated/disabled in a guardian/conservator case; and
WHEREAS, in order to process the offset, the Missouri Department of Revenue must have the individual's entire social security number and the National Instant Criminal Background Check System requires both the social security number and the birth date of individuals; and
WHEREAS, the court has directed the use of the confidential Information Filing Sheets to collect social security numbers and birth dates and, it having been determined that such information is not being provided regularly;
NOW THEREFORE, IT IS ORDERED that, effective May 1, 2006, the requirement of the use of the confidential Information Filing Sheet with complete social security numbers and birth dates of the parties is mandated before the Court will accept any new estate or trust filings. Any such filings without the confidential Information Filing Sheet will be returned to the presenter.
